Terms and conditions
The terms for using this site and for working with me. Written to be read, not to catch you out.

What this page is
These are the terms for using this website and for working with me. Nothing here is meant to be clever or to catch you out. If something reads as unfair, tell me and we will sort it out.
Who you are dealing with
ForgeBrands is a sole proprietorship operated by Jacob Wilson in Albuquerque, New Mexico. Contact: jacobwilsonmarketing26@gmail.com or 505-290-1069.
The website itself
Everything on this site is here for information. Prices, timescales and examples describe how I normally work, and they are not an offer you can accept by clicking. Nothing becomes binding until you and I have agreed the work in writing.
The words, design, logo and code on this site are mine. Please do not copy them for your own business. You are very welcome to link to any page.
Quotes and prices
I quote one fixed number for the work, in writing, before anything starts. That is the number you pay. I do not bill by the hour and I do not add to the number afterwards for work that was in the agreed scope. If you ask for something outside that scope, I will tell you what it costs before I do it, not after.
Prices shown on this site are in US dollars and do not include costs you pay directly to other companies, such as your web address, which is up to about $50 a year. I host the website for now.
What I promise
These are the promises made on the home page, repeated here so they form part of the terms:
- One number, agreed in writing before anything starts.
- I keep working until you are happy with it. Changes during the build are part of the job, not an extra.
- If you get to the end and do not want to put it live, you do not pay, and you owe me nothing.
- You own everything I build for you. The files are yours, you can take them anywhere, and there is no monthly fee to keep your own website running.
The third promise has one sensible limit: it covers you deciding the work is not right for you. It does not cover taking the work, publishing it, and then declining to pay.
The founding offer
A limited number of local businesses get the full build with no charge for my labor while I build up work to show. In exchange I ask for a photo together and permission to show the work publicly, and, if you are happy with it, an honest Google review and an introduction to another owner. Honest means honest: a bad review is a bad review, and I will not ask you to change it. You still pay for your own web address. For the first five clients I keep making changes for 30 days after launch until you are happy with the result. I decide who fits the offer, and I can change or end it at any time.
What I need from you
For the work to run on time I need materials, feedback and approvals within a reasonable time, and I need the things you give me to be yours to give. If you hand me a photo, a logo or text, you are confirming you have the right to use it. Delays on your side move the finish date.
Who owns what
Once you have paid the agreed price, the work I made for you is yours. I keep the right to show it in my portfolio, and to reuse my own underlying tools and techniques, which are not specific to you. Fonts, stock images and third-party software stay under their own licences.
What I do not do
I do not run paid advertising, and I do not take heating, cooling or plumbing work. I cannot promise a particular position in Google, a particular number of customers, or a particular amount of revenue. Anyone who does promise you that is guessing. What I can promise is the work itself, done properly.
Liability
To the extent the law allows, my total liability for any claim connected to the work is limited to the amount you actually paid me for it. I am not liable for lost profits or other indirect losses. Nothing here limits liability for fraud, or for anything that cannot legally be limited.
Which law applies
These terms are governed by the laws of the State of New Mexico, United States, and any dispute belongs in the courts of Bernalillo County, New Mexico. If any part of these terms turns out to be unenforceable, the rest still stands.
If this page changes
I will change the date at the top. The terms that apply to your project are the ones in force when you and I agreed the work.
